When John Radford’s sculpture (shown here in Western Park, Auckland) was used by clothing manufacturer and retailer Hallensteins to decorate a t-shirt without his agreement, he went to court. But the court decided that, under section 73 of the Copyright Act, Hallensteins was engaged in a permitted activity. Some copying of sculptures, models for building or works of artistic craftsmanship that were permanently situated in a public place was allowed.
